The consumer, as the buyer, enters into a sales contract with DEV&ART d.o.o. za trgovinu i usluge, Ulica Ivana Meštrovića 35, 10360 Sesvete (hereinafter: DEV&ART d.o.o.), as the seller.

Legal entities acting as buyers are subject to the Civil Obligations Act and the Electronic Commerce Act; the Consumer Protection Act does not apply to them. These Terms of Use apply to legal entities insofar as they concern the main product characteristics, the contract formation process, product prices, payment methods and dispatch, delivery methods, delivery costs and general information. At its discretion, the seller may grant a legal entity, in an individual case, rights otherwise available to a buyer who is a consumer.

A user is any person who uses the website www.locsandbraids.art, including every buyer and visitor to the website www.locsandbraids.art.

Sales contracts concluded through the website www.locsandbraids.art are governed by applicable legal provisions, taking particular account of the principles and provisions of European Union directives and regulations. Entering into a contract through the website www.locsandbraids.art constitutes entering into a distance contract.

These Terms of Use also constitute pre-contractual information where a sales contract is concluded by a consumer: any natural person entering into a legal transaction or acting in the market outside their trade, business, craft or profession. This applies where a contract is concluded between a trader and a consumer under an organised distance sales or service-provision scheme, without their simultaneous physical presence in one place, using exclusively one or more means of distance communication up to and including the conclusion of the contract.

Means of distance communication are any means that can be used to conclude a distance contract without the simultaneous physical presence of the trader and the consumer, such as the internet and email.

The contract is concluded when the seller receives an electronic message containing the buyer's statement accepting the offer. The seller may terminate the sales contract if the buyer does not pay the purchase price and is not required to deliver the products until payment has been received, unless the buyer has selected cash on delivery. If the buyer does not collect the parcel and it is returned to the seller, the seller will not make further delivery attempts.

The content of the website www.locsandbraids.art is available in Croatian. The official language for concluding sales contracts is Croatian.

Main product characteristics

The buyer can find the main product characteristics on the website www.locsandbraids.art.

DEV&ART d.o.o. reserves the right to change information on the website, including product prices and promotional offers, without prior notice.

The main product characteristics and price are described alongside the product image. Prices, payment terms and promotional offers apply only at the time of ordering and/or payment.

Contract formation process

Purchases are made on the DEV&ART d.o.o. website, www.locsandbraids.art, by completing the designated form. The buyer must provide all requested information. A purchase may be made only after the buyer confirms that they have read, understood and accepted the Terms of Use and acknowledge that the order entails an obligation to pay. Purchases can be made 24 hours a day, 7 days a week. DEV&ART d.o.o. is not responsible for the cost of the computer equipment or telecommunications services required to access the service. The buyer will receive an email confirming the order (receipt of the electronic message containing the buyer's acceptance of the offer) and the dispatch of the parcel.

If, for any reason, DEV&ART d.o.o. cannot deliver an ordered product, the order processing time no longer applies. A DEV&ART d.o.o. employee will contact the buyer by telephone or email to arrange delivery of a replacement product or cancellation of the ordered product and, where applicable, termination of the contract.

Only their legal representatives may request purchases on behalf of minors or persons wholly or partly deprived of legal capacity.

Purchases are made by ordering available products selected by the buyer on the basis of a photograph and a basic description. Photographs are illustrative and may not always correspond to the available products in every detail. The purchase can be completed in a few simple steps from the comfort of the buyer's home, anywhere in the world.

  1. Products can be searched using various criteria. Entering a term in the "Search" field displays products related to that term. The buyer may select a product of interest and read its available description to decide independently whether it meets their needs. Products are selected from the DEV&ART d.o.o. catalogue, which is organised by product type.
  2. Products are ordered electronically. Clicking "Add to basket" adds the selected product to the basket. Adding a product to the basket does not reserve, order or purchase it. The buyer can continue adding products by selecting another product category or clicking "Add other products", remove a selected product by clicking "Remove", or finish selecting products by clicking "Buy". Clicking "Buy" takes the buyer to a page where the following information is required to place an order: email address, first name, surname, street, house number, city, country, postcode and telephone number. Registered users can sign in by clicking "Sign in" and entering their email address and password. The buyer must then select delivery by a delivery service. The purchase cannot proceed without ticking "I have read and accept the Terms of Use", confirming that the buyer has read, understood and accepted these Terms of Use. If the buyer wishes to purchase the products in the basket, they can click "Continue and choose a payment method". They must then select the payment method (cash on delivery, paid to the courier upon receipt) and the billing address, which may be the same as the delivery address or a different address. To confirm the order, the buyer clicks "Place order".
  3. After the buyer places an order, the seller will email the Terms of Use together with the order confirmation, confirming the concluded sales contract and its number, and acknowledging that the order has been received and is being processed.
  4. The seller will email the buyer to confirm that the parcel has been dispatched.
  5. If the buyer does not receive the paid-for products within the agreed delivery period, they must notify DEV&ART d.o.o. by email at contact@devart.hr.
  6. If the buyer has not received the purchase confirmation by email, they must contact the seller at contact@devart.hr or on +385 92 3968 946 on working days between 11:00 and 16:00.
  7. If there are any problems or uncertainties during ordering, the buyer may contact DEV&ART d.o.o. at contact@devart.hr or on +385 92 3968 946 on working days between 11:00 and 16:00.

Product prices, payment methods and dispatch

The buyer undertakes to pay for the ordered products using one of the following payment methods:

  • Cash on delivery (upon receipt of the parcel) allows the buyer to pay the order amount to the courier when it is delivered to the address. Cash on delivery is available only in cash.
  • Payment by payment slip, bank transfer or online banking.

The product will be delivered to the buyer within the Republic of Croatia within 10 working days (excluding Saturdays, Sundays and non-working days) of the conclusion of the sales contract. We normally hand the product to the courier (GLS Croatia d.o.o.) within 1 to 4 working days of the conclusion of the sales contract.

The agreed purchase price includes all taxes and charges and is expressed in euros.

Delivery methods

DEV&ART d.o.o. delivers orders within the timeframes stated under "Product prices, payment methods and dispatch". Products are delivered by the following companies:

  • GLS Croatia d.o.o., Stupničke Šipkovine 22, Donji Stupnik, OIB: 88360795357

DEV&ART d.o.o. checks the condition of every ordered product before dispatch.

TDelivery costs

Delivery within Croatia is free for purchases over €70.00. For purchases up to that amount, delivery costs are payable by the buyer.

DEV&ART d.o.o. delivers products only within the Republic of Croatia, Slovenia, Serbia, Bosnia and Herzegovina, and Montenegro.

Buyers must receive and inspect the parcel in the courier's presence to avoid subsequent complaints about possible damage during delivery.

If DEV&ART d.o.o. cannot deliver an ordered product, it will notify the buyer. The buyer may cancel the order or wait until the product is available again. If DEV&ART d.o.o. cannot deliver within the agreed period, it will notify the buyer, who must allow a reasonable additional period for fulfilment of the sales contract.

If the buyer does not collect the product or refuses it without a valid reason, DEV&ART d.o.o. reserves the right to seek reimbursement of handling, transport and any other costs.

These Terms of Use also incorporate the General Personal Data Protection Terms.

Material defects

DEV&ART d.o.o. (hereinafter: the seller) is liable for material defects in the product up to the transfer of risk to the buyer (when possession is handed to the buyer or a third party designated by the buyer other than the carrier), whether or not the seller knew of the defect. The seller is also liable for defects arising after the transfer of risk if they result from a cause that existed beforehand. A defect appearing within 1 month of the transfer of risk is presumed to have existed at that time, unless the seller proves otherwise or the nature of the product or defect indicates otherwise. A defect exists:

  1. if the product lacks the properties needed for its ordinary use or marketability;
  2. if the product lacks the properties needed for the buyer's intended special use, which was known or should have been known to the seller;
  3. if the product lacks expressly or implicitly agreed or prescribed properties and characteristics;
  4. if the seller delivers a product that does not match the sample or model, unless the sample or model was shown for information only;

  5. if the product lacks properties normally found in other products of the same kind that the buyer could reasonably expect given its nature, particularly considering public statements by the seller, manufacturer or their representatives about its properties (advertising, labelling, etc.).

The consumer must notify the seller of visible defects within two months of discovering them and no later than two years after the transfer of risk to the consumer.

If a defect that could not be detected by a normal inspection upon receipt becomes apparent later, the buyer must notify the seller within two months of discovering it, failing which they may lose their rights.

The seller is not liable for defects that appear more than two years after delivery. A buyer who has notified the seller of a defect in time loses the associated rights two years after sending the notification, unless the seller's fraud prevented the buyer from exercising them.

If a material defect is established, the seller may have one of the following obligations, in accordance with the Civil Obligations Act:

  1. remedying the defect;
  2. providing a replacement product without the defect;
  3. reducing the price;
  4. terminating the contract.

Rights arising from material defects are governed by the Civil Obligations Act.

In addition to liability for material defects, the trader provides customers with warranty rights for a period of 24 months.

Where the buyer is a legal entity, the Civil Obligations Act governs material defects. In particular, where its rules for legal entities differ from those stated in these Terms of Use, the Civil Obligations Act applies.

Right of withdrawal

The consumer may withdraw from the contract within 14 days without giving a reason.

The 14-day period begins on the day possession of the product is handed to the consumer or a third party designated by the consumer other than the carrier.

If the consumer orders multiple products in a single order for separate delivery, or goods delivered in several parts or consignments, the 14-day period begins when possession of the last product or consignment is handed to the consumer or a third party designated by the consumer other than the carrier.

If regular delivery of goods over a specified period has been agreed, the 14-day period begins when possession of the first product or consignment is handed to the consumer or a third party designated by the consumer other than the carrier.

If the consumer has not been informed of the right of withdrawal, that right expires 12 months after the end of the initial 14-day period.

If the seller informs the consumer of the right of withdrawal within those 12 months, the right expires 14 days after the consumer receives that information.

To exercise the right of withdrawal, the consumer must inform the seller of their decision before the 14-day period expires by sending an unequivocal statement by post to DEV&ART d.o.o., Ulica Ivana Meštrovića 35, 10360 Sesvete, or by email to contact@devart.hr. The statement must include their first name and surname, address, telephone number or email address. The seller will acknowledge receipt of the withdrawal statement by email without delay. Upon withdrawal, each party must return what it received under the contract. Unless the seller has offered to collect the returned goods, the seller must reimburse payment only after the goods have been returned or after the consumer provides proof of sending them back, whichever the seller learns of first. The seller is not required to reimburse additional costs resulting from the consumer expressly choosing a delivery method other than the cheapest standard delivery offered by the seller. Reimbursement must use the same payment method used by the consumer unless the consumer expressly agrees to another method and incurs no additional fees as a result.

Unless the seller has offered to collect the returned goods, the consumer must return them without delay and no later than 14 days after informing the seller of their decision to withdraw.

The consumer is considered to have returned the goods on time if they send them or hand them to the seller or an authorised recipient before the deadline expires.

The consumer must bear all direct costs of returning the products. The consumer is liable for any reduction in value resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the products.

To establish the nature, characteristics and functioning of the goods, the consumer may handle and inspect them only as would normally be permitted when buying them on the seller's premises. Goods intended for return within 14 days must not be installed, used or removed from their original packaging. In particular, the buyer must not take actions that would not be permitted in the seller's physical store or that would reduce the goods' value.

During the period in which the consumer exercises the right of return, the goods must be kept with due care and handled diligently and conscientiously. If handling reduces the product's value, the seller will deduct the corresponding amount from the purchase price received, based on its own assessment using objective criteria for each individual case.

The right to withdraw from a sales contract does not apply in the following cases:

  • where the contract concerns sealed goods unsuitable for return for health or hygiene reasons that were unsealed after delivery;

  • where the contract concerns accommodation other than residential accommodation, transport of goods, vehicle hire, catering or leisure-related services to be provided on a specified date or during a specified period.

The section of these Terms of Use entitled "Right of withdrawal" does not apply to legal entities. The Civil Obligations Act and the Electronic Commerce Act apply to them.

How consumers can submit written complaints

In accordance with Article 10 of the Consumer Protection Act, consumers may submit complaints by post to DEV&ART d.o.o., Ulica Ivana Meštrovića 35, 10360 Sesvete, or by email to contact@devart.hr.

For DEV&ART d.o.o. to respond to a written complaint not submitted by email, consumers are asked to provide their correct first name, surname and the address to which the response should be sent. DEV&ART d.o.o. is legally required to respond in writing within 15 days of receiving the complaint.

In the event of a dispute, DEV&ART d.o.o. and the consumer will seek an amicable resolution. If this is not possible, the court with subject-matter and territorial jurisdiction will be competent, and Croatian law will apply. Disputes may also be resolved before the Court of Honour of the Croatian Chamber of Economy or other mediation centres.

Consumer disputes may be resolved through the European Commission's ODR platform at https://webgate.ec.europa.eu/odr/main/index.cfm?event=main.home.show&lng=HR.

By accepting these Terms of Use, the consumer also accepts all other terms and provisions stated on www.locsandbraids.art. A consumer who does not agree with any part of the pre-contractual information or the Terms of Use is asked not to use the website or enter into a sales contract.

DEV&ART d.o.o. reserves the right to change these Terms of Use and rules without prior notice. The Terms of Use comply with the laws of the Republic of Croatia and the European Union acquis.

Where the buyer is a legal entity, the consumer protection rules in these Terms of Use and the Consumer Protection Act do not apply.

The rules concerning consumers' written complaints do not apply to legal entities, which are subject to the Civil Obligations Act and the Electronic Commerce Act.

Purposes for processing personal data

We process your personal data to comply with legal requirements, perform a contract, take steps before entering into a contract, or pursue our legitimate interests, unless those interests are overridden by individuals' interests or fundamental rights and freedoms requiring protection of personal data. If we cannot process personal data on these legal grounds, we will request your consent. Where processing is based on consent, you may withdraw it at any time. Please notify the controller of your withdrawal by email at: contact@devart.hr. Withdrawal will not affect the lawfulness of processing based on consent before it was withdrawn.

Right to object: under certain conditions, you may object at any time to processing of your personal data on grounds relating to your particular situation, or where data is processed for direct marketing, and request that we stop processing it.

Right to data portability: under certain conditions, you have the right to receive the personal data you have provided to us in a structured, commonly used and machine-readable format and to transmit it to another controller without hindrance from us.

They must also protect your data appropriately and treat it as confidential business information.

In some cases, partners providing services on behalf of or for DEV&ART d.o.o. may process your data outside the European Union. Our contracts with them require particular safeguards in accordance with the regulations in force in the European Union.
